Sales Contract 

This is a virtual sales contract between Pergamon Marble and the Customer.

Article - 1 

Is the subject of this contract, the seller sells to the buyer, regarding the sale and delivery of the product whose qualifications and sales price are specified below, Law No. 4077 on the Protection of Consumers; It covers the rights and obligations of the parties in accordance with the provisions of the Regulation on the Application Principles and Procedures of Distance Contracts.

Article - 3 

BUYER INFORMATION 

All members: All buyers who are members of Pergamon Marble Company's e-commerce store www.pergamonmarble.com and make purchases (hereinafter referred to as buyers or customers).

Article - 4 

CONTRACT SUBJECT AND PRODUCT INFORMATION: 

Type, Quantity, Brand / Model, Color, Number, Sales Price and Payment Method of the Goods / Products or Services are as stated on the website and these promises may change without notifying the buyer. All of the products on the Mermerevim site, the majority of which consist of marble and natural stone, may show color and visual differences due to their nature, and the BUYER accepts that there may be such differences in the products.

Article - 5 

GENERAL PROVISIONS 

5.1 - The BUYER declares that he / she has read and informed all preliminary information regarding the basic qualities, sales price and payment method and delivery of the product subject to the contract specified in Article 4 and that he / she has given the necessary confirmation electronically.  

5.2 - The product subject to the contract is delivered to the buyer or the person or organization at the address indicated in the preliminary information within the period described in the preliminary information, depending on the distance of the buyer's settlement for each product, provided that it does not exceed the legal 30-day period. 

5.3 - If the product subject to the contract will be delivered to a person or organization other than the buyer, the SELLER cannot be held responsible for the refusal of the person or organization to be delivered. 

5.4 " SELLER is responsible for the delivery of the product subject to the contract intact, complete, in accordance with the qualifications specified in the order and with warranty documents and user manuals, if any. 

5.5 - For the delivery of the product subject to the contract, this contract must be approved electronically and the sale price must be paid with the payment method preferred by the buyer. If for any reason the product price is not paid or canceled in bank records, the SELLER is not obliged to deliver the product. 

5.6 - After the delivery of the product, if the relevant bank or financial institution does not pay the product price to the SELLER due to the unfair or unlawful use of the credit card of the buyer by unauthorized persons in a way that is not caused by the fault of the buyer, the BUYER is obliged to send the product delivered to the SELLER within 3 business days. In such a case, transportation expenses belong to the buyer. 

5.7 - If the SELLER cannot deliver the product subject to the contract within the period due to force majeure or extraordinary circumstances such as weather opposition that prevents transportation, interruption of transportation, it is obliged to notify the buyer. In this case, the buyer may exercise one of the rights to cancel the order, to replace the product subject to the contract with its equivalent, if any, and / or to postpone the delivery period until the elimination of the preventive situation. In case the buyer cancels the order, the SELLER shall make an attempt before the relevant bank to cancel the credit card receipt of the buyer within 7 days and return the relevant amount to the buyer's account and the transaction shall be notified to the BUYER via e-mail. In such a case, the SELLER cannot be held responsible for delays caused by the relevant bank. 

5.8 - In the event that the products delivered to the BUYER and / or the persons and / or institutions to which the BUYER and / or the BUYER wants delivery to be made are defective or defective, the relevant product or products shall be sent to the SELLER within 7 days starting from the date of receipt by the BUYER and the transportation costs shall be borne by the BUYER in order to make the necessary repair or replacement within the warranty conditions. In such a case, if the 7-day period expires, the BUYER is obliged to take the product to the relevant service. 

5.9- This contract becomes valid after it is electronically approved by the buyer (after the membership is realized) and delivered to Pergamon Marble address.

5.10 - For special production and design products, the customer confirms the order with advance payment and in case of order cancellation or withdrawal, it is not possible to refund the advance payment after the production starts.

5.11- The parties agree to comply with the Law No. 6698 on the Protection of Personal Data and all other applicable data protection legislation within the scope of the execution of the contract regarding the data sharing they will make, except as agreed in this contract; they will not use the personal data of the other party for any other purpose, will not disclose it to third parties and will not disclose it to third parties and will not disclose it to domestic / foreign
